Commercial Premises
Do you have problems with commercial lease tenants not paying their rent? Would you like your property repossessed so it can be re-let?
Provided that the lease contains a forfeiture clause giving the landlord the right to terminate the lease and ‘re-enter’ the premises following a breach, the tenants lease agreement can be forfeited on several grounds without going to Court:
* If rent arrears remain outstanding after a specified period
* If the tenant is made bankrupt
* If the tenant goes into administration, liquidation or appointments a receiver
* If there is a breach of a covenant
As a landlord all you have to do to instigate a Peaceful Possession procedure is to instruct a Certificated Enforcement Officer to act on your behalf. This is an effective method if the Officer cannot levy distress because either they can’t gain entry or there are insufficient goods to seize or all goods belong to third parties.

Commercial Squatters
Another common problem is that of Commercial Squatters, and Able has an experienced team ready to help you re-possess your property quickly and efficiently. A landlord has the right to obtain peaceful possession of their property and can appoint Enforcement Officers to do this for them.
So long as the premises are open and the squatter is trading the process involves simply walking peacefully into the property and occupying it, thereby preventing the squatter from trading, and any potential customer from entering the premises. Reasonable force may be used to evict the squatters, removing their goods and placing them on the street within their sight.
